    APS Double Glazing Terms and Conditions

    Last updated: 28 September 2026

    These Terms and Conditions apply to the supply of double glazed windows, doors, glazing, associated products and installation services by APS Double Glazing Pty Ltd (ABN 18 630 600 609).

    Please read these Terms and Conditions carefully before accepting a Quote, signing a contract, paying a deposit or engaging APS to provide products or services.

    1. Definitions

    In these Terms and Conditions:

    • Australian Consumer Law or ACL means the Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth).
    • APS, we, us or our means APS Double Glazing Pty Ltd (ABN 18 630 600 609).
    • Building Contract means any domestic building contract entered into between APS and the Customer where the Domestic Building Contracts Act 1995 (Vic) applies.
    • Customer, you or your means the person or entity identified as the customer in a Quote, order or Building Contract.
    • DBC Act means the Domestic Building Contracts Act 1995 (Vic).
    • Goods means any windows, doors, glass, frames, hardware, accessories, materials or other products supplied by APS.
    • Quote means any written quotation, proposal, estimate or order document issued by APS.
    • Services means any services supplied by APS, including measuring, design, manufacturing, delivery, removal of existing windows or doors, installation and related work.
    • Site means the property where the Goods are to be delivered or the Services performed.
    • Terms means these Terms and Conditions.

    2. Application of These Terms

    These Terms apply to all Goods and Services supplied by APS unless otherwise agreed by us in writing.

    By accepting a Quote, signing a Building Contract, paying a deposit or instructing us to commence work, you agree to these Terms.

    If there is an inconsistency, the following order of priority applies:

    1. any mandatory requirement of the DBC Act, the ACL or other applicable legislation;
    2. the Building Contract, where one applies;
    3. the accepted Quote, including any special conditions; and
    4. these Terms.

    Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the ACL, the DBC Act or any other law.

    3. Domestic Building Work in Victoria

    Where the Services are domestic building work to which the DBC Act applies, APS will:

    • provide a written Building Contract that complies with the DBC Act where required;
    • not require a deposit greater than the amount permitted under the DBC Act;
    • take out domestic building insurance where required by law;
    • carry out the work as a registered building practitioner where required; and
    • provide the statutory warranties implied by the DBC Act.

    You may have cooling-off rights under the DBC Act or the ACL. Any such rights will be set out in your Building Contract or Quote.

    4. Quotes

    Unless otherwise stated, a Quote is valid for 30 days from the date of issue.

    A Quote is based on the information available at the time it is prepared, including measurements, plans, photographs and information provided by the Customer. It may be subject to a final site measure before manufacturing begins.

    APS may revise a Quote where:

    • measurements, specifications or the scope of work change;
    • information supplied by the Customer is inaccurate or incomplete;
    • site conditions or access differ from those reasonably anticipated;
    • structural or building issues are discovered; or
    • regulatory or compliance requirements change.

    Any material change to price or scope will be communicated to the Customer before the relevant work proceeds, where reasonably practicable.

    5. Measurements, Specifications and Approvals

    Manufacturing is based on APS’s final site measure unless otherwise agreed. Where plans or specifications are supplied by the Customer, a builder, architect or another third party, APS may rely on that information.

    The Customer is responsible for reviewing and approving the final configurations, opening directions, frame styles, glass selections, colours, finishes, hardware, locks, screens, dimensions and quantities shown on the Quote or order documentation.

    Once Goods have entered production, changes may not be possible and may result in additional charges.

    6. Custom-Manufactured Goods

    APS windows and doors are custom manufactured in our Kilsyth factory to suit a particular property and opening.

    Once manufacturing has commenced, an order may not be capable of being cancelled or changed. Subject to the ACL and the DBC Act, amounts relating to Goods already ordered or manufactured may be non-refundable where APS has incurred costs and cannot reasonably resell the Goods.

    7. Pricing and GST

    Unless expressly stated otherwise, prices quoted by APS include GST.

    The price payable is the amount in the accepted Quote or Building Contract, subject to authorised variations.

    Additional charges may apply where circumstances arise that were not reasonably identifiable at the time of quotation, including:

    • concealed structural damage, rot or termite damage;
    • asbestos or other hazardous materials;
    • electrical or plumbing interference;
    • inadequate or unsafe access, or the need for scaffolding, cranes or lifting equipment;
    • rectification of pre-existing defects; or
    • additional work requested by the Customer.

    APS will notify the Customer of any additional costs before undertaking the work, where reasonably practicable.

    8. Payment

    The Customer must pay the amounts specified in the Quote or Building Contract in accordance with its payment schedule.

    A deposit may be required before APS orders materials or commences manufacturing. Progress payments may be required at the stages identified in the Quote or Building Contract.

    If an amount remains unpaid after its due date, APS may, subject to applicable law, suspend production, delivery or installation, recover reasonable debt recovery costs and exercise any other rights available at law.

    9. Finance

    APS partners with Zip Money and may offer other finance options. Finance is provided by the relevant third-party provider, subject to its approval criteria, terms and fees.

    APS does not provide credit and is not responsible for a finance provider’s decision. Where finance is not approved, the Customer remains responsible for payment under the Quote or Building Contract.

    10. Variations

    Any change requested after acceptance of the Quote may constitute a variation, including changes to dimensions, styles, glazing, colours, hardware, quantities, installation method or scope of works.

    Variations will be documented in writing, and in accordance with the DBC Act where it applies. They may result in additional costs and changes to the production or installation schedule.

    11. Delivery and Timeframes

    Any delivery or completion date provided is an estimate unless APS expressly agrees in writing that a date is guaranteed, or a date is set out in a Building Contract.

    Production and installation may be affected by circumstances outside APS’s reasonable control, including supplier delays, material shortages, weather, transport disruption, industrial action and government restrictions.

    APS will take reasonable steps to minimise delays and keep the Customer informed of material changes.

    12. Site Access and Customer Responsibilities

    The Customer must provide APS with safe and reasonable access to the Site and ensure that, before installation:

    • installation areas are clear and accessible;
    • furniture, valuables and window furnishings are moved away from work areas where reasonably required;
    • pets and children are kept clear of work areas;
    • electricity is available;
    • any strata, owners corporation, landlord or heritage approvals the Customer is responsible for have been obtained; and
    • APS has been informed of known hazards or unusual conditions at the Site.

    The Customer warrants that they have authority to authorise APS to access and perform work at the Site.

    13. Existing Structures and Conditions

    Replacing windows and doors may reveal conditions that could not reasonably have been identified beforehand, such as structural deterioration, water damage, rot, termite damage, asbestos, defective flashing, building movement or non-compliant construction.

    Unless included in the Quote, rectification of these conditions is not included in the price. APS will discuss the options and any associated cost with the Customer before proceeding.

    14. Installation

    Installation is included only where stated in the Quote.

    Installation is carried out by APS’s own employed and trained installers with due care and skill and in accordance with applicable standards. Specialist services such as scaffolding or cranes may be provided by third parties where required.

    Replacement work may cause minor disturbance to surrounding finishes. Unless included in the Quote, APS is not responsible for painting, plastering, rendering, tiling, flooring, electrical work, alarm systems, blinds or curtains.

    Removal and disposal of existing windows and doors is included only where stated in the Quote. If suspected asbestos or other hazardous materials are found, work may be suspended until the Site can be made safe, and additional charges may apply.

    15. Supply-Only Orders

    Where Goods are supplied without installation, the Customer is responsible for ensuring they are installed by a suitably qualified installer in accordance with applicable standards and APS’s installation guidelines.

    To the extent permitted by law, APS is not responsible for defects, leaks or performance issues caused by installation carried out by others.

    16. Product Appearance and Performance

    Reasonable variations may occur between samples, photographs, displays and finished products, including minor differences in colour, texture, glass appearance and manufacturing tolerances. These are not defects where the Goods remain of acceptable quality and meet the applicable specifications.

    All APS products are manufactured to AS 2047, with glass units meeting AS 1288. Published U-values, Rw ratings and WERS data are for the tested product configuration.

    Actual thermal, acoustic and condensation performance in your home depends on factors beyond the window or door itself, including building design, orientation, insulation, air leakage, noise type and occupant behaviour. Any specific performance guarantee must be stated in writing in the Quote.

    17. Inspection and Defects

    The Customer should inspect the Goods and installation within a reasonable period after completion and notify APS of any defect as soon as reasonably practicable.

    APS may request photographs, videos, details of the issue and access to inspect.

    The Customer should give APS a reasonable opportunity to inspect and remedy an alleged defect before arranging third-party repairs, except where urgent work is reasonably necessary.

    18. Warranties and Consumer Guarantees

    APS Goods and Services come with guarantees that cannot be excluded under the ACL. Where the DBC Act applies, the statutory warranties in that Act also apply.

    Product and installation warranty periods are set out in the Quote, Building Contract or APS warranty documentation. Any APS or manufacturer warranty is in addition to your rights under the ACL and the DBC Act.

    To the extent permitted by law, a warranty may not apply where damage or failure is caused by:

    • misuse, accidental or impact damage;
    • failure to follow care and maintenance instructions;
    • modifications or repairs by unauthorised third parties;
    • building or structural movement;
    • damage caused by other trades;
    • unsuitable chemicals or cleaning products;
    • extreme conditions outside product specifications; or
    • fair wear and tear.

    19. Promotions

    From time to time, APS may offer discounts, promotions or special offers, such as savings on orders of multiple items.

    Unless otherwise stated:

    • promotions apply only to replacement windows and doors for existing homes;
    • new construction and supply-only projects are quoted separately and are not eligible;
    • promotions apply only to Quotes accepted during the advertised period;
    • discounts are calculated on the eligible items in the accepted Quote;
    • promotions cannot be applied retrospectively or exchanged for cash; and
    • offers cannot be combined unless APS agrees in writing.

    Where specific promotional terms conflict with these Terms, the promotional terms apply to that promotion.

    20. Cancellation

    A request to cancel an order must be made in writing.

    Subject to any cooling-off rights and to the ACL and the DBC Act, APS may retain or recover reasonable amounts representing costs actually incurred as a result of cancellation, including for Goods already manufactured that cannot reasonably be resold.

    APS may suspend or cancel an order where the Customer fails to pay when due, materially breaches these Terms, the Site is unsafe, required access or approvals are not provided, or continuing would breach a legal or safety requirement. Where appropriate, APS will give reasonable notice and an opportunity to remedy the breach.

    21. Title and Risk

    To the extent permitted by law, ownership of Goods does not pass to the Customer until all amounts payable for those Goods have been paid in full. Risk in Goods passes in accordance with the circumstances of delivery or installation and applicable law.

    22. Liability

    Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

    To the maximum extent permitted by law, APS is not liable for loss or damage caused by inaccurate information supplied by others, work performed by other contractors, existing defects in the property, building movement, misuse, unauthorised modification or failure to maintain the Goods.

    23. Photography and Marketing

    APS may request permission to photograph completed work for its gallery, website, social media and advertising. We will not publish identifying details, such as your name or street address, without your consent.

    You may tell APS in writing if you do not want photographs of your property used.

    24. Privacy

    APS collects personal information to prepare Quotes, manufacture and install Goods, process payments, provide warranty support and administer the customer relationship. Personal information is handled in accordance with our Privacy Policy.

    25. Intellectual Property

    All drawings, designs, specifications, images and documents created by APS remain the intellectual property of APS unless otherwise agreed in writing. The Customer must not reproduce or use them for commercial purposes without permission.

    26. Disputes

    If you have a concern, please contact APS first so we can work to resolve it.

    Where a dispute relates to domestic building work, you may contact Domestic Building Dispute Resolution Victoria (DBDRV). Other disputes may be referred to Consumer Affairs Victoria or the Victorian Civil and Administrative Tribunal (VCAT), as applicable.

    27. General

    If any provision of these Terms is invalid or unenforceable, it will be read down or severed to the minimum extent necessary, and the remaining provisions will continue to operate.

    A failure or delay in exercising a right is not a waiver of that right.

    The accepted Quote, any Building Contract, these Terms and any document expressly incorporated form the agreement between APS and the Customer. Any variation must be agreed in writing.

    Notices may be sent by email, post or another written method normally used between APS and the Customer.

    28. Governing Law

    These Terms are governed by the laws of Victoria, Australia. The parties submit to the jurisdiction of the courts and tribunals of Victoria. Nothing in this section prevents a consumer from exercising any right available under applicable consumer or building legislation.
